Inourfreesociety,peoplehavetherighttochoosehowtheylivetheirlives.Andinafreesociety,decisioaboutsuchafundamentalsocialititutionasmarriageshouldbemadebythepeople--notbythecourts.TheAmericanpeoplehaveokenclearlyonthisiue,boththroughtheirrepresentativesandattheballotbox.In1996,CongrearovedtheDefeeofMarriageActbyoverwhelmingbipartisanmajoritiesinboththeHouseandSenate,andPresidentClintonsigneditintolaw.Andsincethen,votersin19stateshavearovedamendmentstotheirstatecotitutiothatprotectthetraditionaldefinitionofmarriage.Andtoday,45ofthe50stateshaveeitherastatecotitutionalamendmentorstatutedefiningmarriageastheunionofamanandawoman.Theseamendmentsandlawsexpreabroadcoeusinourcountryforprotectingtheititutionofmarriage.

Unfortunately,activistjudgesandsomelocalofficialshavemadeanaggreiveattempttoredefinemarriageinrecentyears.Since2004,statecourtsinWashington,California,Maryland,andNewYorkhaveoverturnedlawsprotectingmarriageinthosestates.AndinNebraska,afederaljudgeoverturnedastatecotitutionalamendmentbaingsame-sexmarriage.
